Terms and Conditions

This page contained Foxy Go Lightly's Terms and Conditions.  Please read these Terms and Conditions before placing your order from Foxy Go Lightly.  By placing your order, you agree to be bound by these Terms and Conditions.

PRODUCTS PROVIDED

Foxy Go Lightly provides handmade items for purchase.  Because the items are handmade, there may be slight variations in the color, shape and size from one item to the other.

PAYMENT

Foxy Go Lightly accepts PayPal as a form of payment.  If you do not have a PayPal account, you can still use PayPal to pay with your credit card or debit card without signing up for a PayPal account. Payment is due at the time of purchase.  Special payment arrangements may be made for large custom orders.

LEAD TIMES

For each custom item, Foxy Go Lightly will provide lead times either on the product page or by an e-mail. Depending on the item, lead times can range from 3 days to 3 weeks.  Large items or items requiring complex designs may take up to 3 weeks to make.

SHIPPING AND DELIVERY

Shipping and delivery is currently provided by the United States Postal Service.  Standard delivery service can take 2 to 8 days. Priority Mail and Priority Mail Express is also available which may shorten the delivery time, but may increase your shipping cost.  At this time, Foxy Go Lightly only provides shipping throughout the continental United States.

GUARANTEES AND WARRANTIES

All of our items are being sold “as is,” and Foxy Go Lightly disclaims all warranties of quality, whether express or implied, including the warranties of merchantability and fitness for particular purpose. You acknowledge that you have not been induced by any statements or representations of any person with respect to the quality or condition of our items and that no such statements or representations have been made.  You acknowledge that you have relied solely on the investigations, examinations, and inspections as you have chosen to make and that Foxy Go Lightly has afforded you the opportunity for full and complete investigations, examinations, and inspections. 

RETURNS AND REFUNDS

Unfortunately, returns and refunds are not available for our handmade or custom items.  Should you have an issue with the quality of the item purchased, please contact us and we will work to make things right!

LIMITATION OF LIABILITY

Foxy Go Lightly will not be liable for any indirect, special, consequential, or punitive damages (including lost profits) arising out of or relating to these Terms and Conditions or the transactions it contemplates (whether for breach of contract, tort, negligence, or other form of action) and irrespective of whether Foxy Go Lightly has been advised of the possibility of any such damage.  In no event will Foxy Go Lightly's liability exceed the price the customer paid for the specific items provided by Foxy Go Lightly giving rise to the claim or cause of action. 

CHANGES

Foxy Go Lightly reserves the right to modify or replace these Terms and Conditions at any time.  If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect.  Foxy Go Lightly, in its sole discretion, will determine what a material change is. 

GOVERNING LAW

These Terms and Conditions shall be governed and construed in accordance with the laws of the United States and by the laws of the State of Florida, U.S.A.  You agree to the personal jurisdiction by and venue in the state and federal courts in Miami-Dade County, Florida, and waive any objection to such jurisdiction or venue.  Failure to enforce any right or provision of these Terms and Conditions will not be considered a waiver of those rights.  If any provision of these Terms and Conditions is held to be invalid or unenforceable by a court, the remaining provisions of these Terms and Conditions will remain in effect.  These Terms and Conditions constitute the entire agreement between you and Foxy Go Lightly regarding the sale of our items, and supersede and replace any prior agreements.
